The doctrine of separation of powers implies that each pillar of democracy – the executive, legislature and the judiciary – perform separate functions and act as separate entities.  The executive is vested with the power to make policy decisions and implement laws.  The legislature is empowered to issue enactments.  The judiciary is responsible for adjudicating disputes.  The doctrine is a part of the basic structure of the Indian Constitution[1] even though it is not specifically mentioned in its text.  Thus, no law may be passed and no amendment may be made to the Constitution deviating from the doctrine.  Different agencies impose checks and balances upon each other but may not transgress upon each other’s functions.  Thus, the judiciary exercises judicial review over executive and legislative action, and the legislature reviews the functioning of the executive. There have been some cases where the courts have issued laws and policy related orders through their judgements.  These include the Vishakha case where guidelines on sexual harassment were issued by the Supreme Court, the order of the Court directing the Centre to distribute food grains (2010) and the appointment of the Special Investigation Team to replace the High Level Committee established by the Centre for investigating black money deposits in Swiss Banks. In 1983 when Justice Bhagwati introduced public interest litigation in India, Justice Pathak in the same judgement warned against the “temptation of crossing into territory which properly pertains to the Legislature or to the Executive Government”[2].  Justice Katju in 2007 noted that, “Courts cannot create rights where none exist nor can they go on making orders which are incapable of enforcement or violative of other laws or settled legal principles. With a view to see that judicial activism does not become judicial adventurism the courts must act with caution and proper restraint. It needs to be remembered that courts cannot run the government. The judiciary should act only as an alarm bell; it should ensure that the executive has become alive to perform its duties.” [3] While there has been some discussion on the issue of activism by the judiciary, it must be noted that there are also instances of the legislature using its law making powers to reverse the outcome of some  judgements.  (M.J. Antony has referred to a few in his article in the Business Standard here.)  We discuss below some recent instances of the legislature overturning judicial pronouncements by passing laws with retrospective effect. On September 7, 2011 the Parliament passed the Customs Amendment and Validation Bill, 2011 which retrospectively validates all duties imposed and actions taken by certain customs officials who were not authorized under the Customs Act to do the stated acts.  Some of the duties imposed were in fact challenged before the Supreme Court in Commissioner of Customs vs. Sayed Ali in 2011[4].  The Supreme Court struck down the levy of duties since these were imposed by unauthorised officials.  By passing the Customs Bill, 2011 the Parliament circumvented the judgement and amended the Act to authorize certain officials to levy duties retrospectively, even those that had been held to be illegal by the SC. Another instance of the legislature overriding the decision of the Supreme Court was seen in the Essential Commodities (Amendment) Ordinance, 2009 which was passed into an Act.  The Supreme Court had ruled that the price at which the Centre shall buy sugar from the mill shall include the statutory minimum price (SMP) and an additional amount of profits that the mills share with farmers.[5] The Amendment allowed the Centre to pay a fair and remunerative price (FRP) instead of the SMP.  It also did away with the requirement to pay the additional amount.  The amendment applied to all transactions for purchase of sugar by the Centre since 1974.  In effect, the amendment overruled the Court decision. The executive tried to sidestep the Apex Court decision through the Enemy Property (Amendment and Validation) Ordinance, 2010.  The Court had issued a writ to the Custodian of Enemy Property to return possession of certain properties to the legal heir of the owner.   Subsequently the Executive issued an Ordinance under which all properties that were divested from the Custodian in favour of legal heirs by a Court order were reverted to him.  The Ordinance lapsed and a Bill was introduced in the Parliament.  The Bill is currently being examined by the Parliamentary Standing Committee on Home Affairs. These examples highlight some instances where the legislature has acted to reverse judicial pronouncements.  The judiciary has also acted in several instances in the grey areas separating its role from that of the executive and the legislature.  The doctrine of separation of powers is not codified in the Indian constitution.  Indeed, it may be difficult to draw a strict line demarcating the separation.  However, it may be necessary for each pillar of the State to evolve a healthy convention that respects the domain of the others.

राज्यसभा में राष्ट्रीय एंटी डोपिंग बिल, 2021 पारित होने के लिए आज सूचीबद्ध है। पिछले हफ्ते लोकसभा ने इस बिल को पारित कर दिया था। बिल खेलों में एंटी-डोपिंग नियमों के उल्लंघनों के लिए एक रेगुलेटरी फ्रेमवर्क बनाता है। खेल संबंधी स्टैंडिंग कमिटी ने इसकी समीक्षा की थी और लोकसभा में बिल को पारित करते समय, उसमें कमिटी के कुछ सुझावों को शामिल किया गया था।

एथलीट्स खेल प्रदर्शन में सुधार करने के लिए कुछ प्रतिबंधित पदार्थों का उपभोग करते हैं। इसे डोपिंग कहा जाता है। विश्व स्तर पर विश्व एंटी-डोपिंग एजेंसी (वाडा) डोपिंग को रेगुलेट करती है। 1999 में स्वतंत्र अंतरराष्ट्रीय एजेंसी के तौर पर इसकी स्थापना की गई थी। वाडा का मुख्य काम, सभी प्रकार के खेलों और देशों में एंटी-डोपिंग रेगुलेशंस को विकसित करना, उनके बीच सामंजस्य पैदा करना और उनका समन्वय करना है। इसके लिए एजेंसी विश्व एंटी-डोपिंग संहिता (वाडा कोडतथा उसके मानकों के कार्यान्वयन को सुनिश्चित करती है। इस ब्लॉग पोस्ट में हम बिल द्वारा प्रस्तावित फ्रेमवर्क की जरूरत के बारे में बात कर रहे हैं और बता रहे हैं कि लोकसभा में बिल पर क्या चर्चा हुई।

भारत में डोपिंग

हाल ही में दो एथलीट्स डोपिंग टेस्ट पास नहीं कर पाए और उन्हें अस्थायी सस्पेंशन का सामना करना पड़ रहा है। इससे पहले भी भारतीय एथलीट्स एंटी-डोपिंग नियमों का उल्लंघन करते पाए गए हैं। वाडा के अनुसार, 2019 में डोपिंग के नियमों के सबसे ज्यादा उल्लंघन रूस (19%), इटली (18%) और भारत (17%) के एथलीट्स ने किए थे। डोपिंग के नियमों के सबसे ज्यादा उल्लंघन बॉडी-बिल्डिंग (22%), एथलेटिक्स (18%), साइकिलिंग (14%) और वेटलिफ्टिंग (13%) में किए गए। खेलों में डोपिंग पर काबू पाने के लिए वाडा यह अपेक्षा करती है कि सभी देशों में एंटी-डोपिंग गतिविधियों को रेगुलेट करने के लिए फ्रेमवर्क हों जिनका प्रबंधन उनके संबंधित राष्ट्रीय एंटी-डोपिंग संगठन करें। 

वर्तमान में भारत में डोपिंग को राष्ट्रीय एंटी-डोपिंग एजेंसी रेगुलेट करती है जिसकी स्थापना 2009 में सोसायटीज़ रजिस्ट्रेशन एक्ट, 1860 के तहत गठित स्वायत्त निकाय के तौर पर की गई थी। मौजूदा फ्रेमवर्क के साथ एक समस्या है, वह यह कि एंटी-डोपिंग नियम कानून समर्थित नहीं है, इसलिए अदालतों में उन्हें चुनौती मिलती रहती है। इसके अतिरिक्त नाडा भी वैधानिक समर्थन के अभाव में एथलीट्स पर प्रतिबंध लगाती है। ऐसे मामलों को देखते हुए संसद की खेल संबंधी स्टैंडिंग कमिटी (2021) ने सुझाव दिया था कि खेल विभाग को एंटी-डोपिंग कानून लाना चाहिए। यूएसए, यूके, जर्मनी और जापान जैसे देशों ने एंटी-डोपिंग गतिविधियों को रेगुलेट करने के लिए कानूनों को लागू किया है।  

राष्ट्रीय एंटी-डोपिंग बिल, 2021 द्वारा प्रस्तावित फ्रेमवर्क

बिल वैधानिक निकाय के रूप में नाडा के गठन का प्रयास करता है जिसके प्रमुख महानिदेशक होंगे और उनकी नियुक्ति केंद्र सरकार द्वारा की जाएगी। एजेंसी के कार्यों में एंटी-डोपिंग गतिविधियों की योजना बनाना, उन्हे लागू और उनकी निगरानी करना, तथा एंटी-डोपिंग के नियमों के उल्लंघनों की जांच करना शामिल है। एंटी-डोपिंग नियमों के उल्लंघन के नतीजों को निर्धारित करने के लिए एक राष्ट्रीय एंटी-डोपिंग डिसिप्लिनरी पैनल बनाया जाएगा। पैनल में कानूनी विशेषज्ञ, मेडिकल प्रैक्टीशनर और रिटायर एथलीट्स होंगे। इसके अतिरिक्त डिसिप्लिनरी पैनल के फैसलों के खिलाफ अपील की सुनवाई के लिए राष्ट्रीय एंटी-डोपिंग अपील पैनल बनाया जाएगा। एंटी-डोपिंग नियमों का उल्लंघन करते पाए जाने वाले एथलीट्स निम्नलिखित के अधीन हो सकते हैं: (i) परिणाम डिस्क्वालिफाई हो सकते हैं जिसमें मेडल, प्वाइंट्स और पुरस्कार को जब्त करना शामिल है, (ii) एक निर्दिष्ट अवधि तक किसी प्रतिस्पर्धा या आयोजन में भाग नहीं ले पाना, (iii) वित्तीय प्रतिबंध, और (iv) अन्य परिणाम, जिन्हें निर्दिष्ट किया जा सकता है। टीम स्पोर्ट्स के परिणामों को रेगुलेशंस के जरिए निर्दिष्ट किया जाएगा। 

शुरुआत में बिल में संरक्षित एथलीट्स के लिए कोई प्रावधान नहीं था लेकिन जब स्टैंडिंग कमिटी ने सुझाव दिए तो ऐसे एथलीट्स से संबंधित प्रावधानों को बिल में शामिल कर लिया गया। केंद्र सरकार द्वारा संरक्षित व्यक्तियों को निर्दिष्ट किया जाएगा। वाडा कोड के अनुसार, एक संरक्षित व्यक्ति वह है: (i) जिसकी आयु 16 वर्ष से कम है, या (ii) उसकी आयु 18 वर्ष से कम है और उसने ओपन श्रेणी में किसी अंतरराष्ट्रीय स्पर्धा में भाग नहीं लिया है, या (iii) अपने देश के कानूनी ढांचे के अनुसार उसमें कानूनी क्षमता का अभाव है।

बिल से संबंधित मुद्दे औऱ लोकसभा में चर्चा

बिल पर चर्चा के दौरान सदस्यों ने कई मुद्दों को उठाया। हम यहां उनकी चर्चा कर रहे हैं-

नाडा की स्वतंत्रता

इस पर जो तमाम मुद्दे उठाए गए, उनमें से एक था, नाडा के महानिदेशक की स्वतंत्रता। वाडा में यह अपेक्षित है कि राष्ट्रीय एंटी डोपिंग संगठन का कामकाज स्वतंत्र हो, चूंकि उसे अपनी सरकार और राष्ट्रीय खेल निकायों के बाहरी दबाव को सामना करना पड़ सकता है और इससे उसके फैसले प्रभावित हो सकते हैं। पहले, बिल में महानिदेशक की क्वालिफिकेशन निर्दिष्ट नहीं है, और इसे नियमों के जरिए अधिसूचित करने के लिए छोड़ दिया गया है। दूसरा, केंद्र सरकार महानिदेशक को दुर्व्यवहार या अक्षमता के आधार पर या ऐसे अन्य आधार पर कार्यालय से हटा सकती है। इन प्रावधानों को केंद्र सरकार के विवेकाधीन छोड़ने से महानिदेशक के स्वतंत्र कामकाज पर असर पड़ सकता है।

एथलीट्स की प्राइवेसी

नाडा के पास एथलीट्स के कुछ पर्सनल डेटा को जमा करने की शक्ति होगी, जैसे: (i) सेक्स या जेंडर, (ii) मेडिकल हिस्ट्री, और (iii) एथलीट्स के पते-ठिकाने की जानकारी (आउट ऑफ कंपीटीशन टेस्टिंग और सैंपल कलेक्शन के लिए)। सांसदों ने एथलीट्स की प्राइवेसी को बरकरार रखने के संबंध में भी चिंता जताई। अपने जवाब में केंद्रीय खेल मंत्री ने सदन को आश्वासन दिया कि डेटा जमा और शेयर करने के दौरान प्राइवेसी के सभी अंतरराष्ट्रीय मानकों का पालन किया जाएगा। डेटा सिर्फ संबंधित अथॉरिटीज़ के साथ शेयर किया जाएगा। बिल के अंतर्गत नाडा प्राइवेसी और व्यक्तिगत सूचना के संरक्षण हेतु अंतरराष्ट्रीय मानकों के अनुरूप एथलीट्स के पर्सनल डेटा को जमा और इस्तेमाल करेगा। यह विश्व एंटी-डोपिंग संहिता के आठ अनिवार्य मानकों में से एक है। केंद्रीय खेल मंत्री ने जितने संशोधन पेश किए, उनमें से एक संशोधन ने प्राइवेसी और व्यक्तिगत सूचना के संरक्षण के लिए अंतरराष्ट्रीय मानकों के पालन से संबंधित प्रावधान को हटा दिया है। 

राज्यों में अधिक संख्या में टेस्टिंग लेबोरेट्रीज़ की स्थापना

वर्तमान में भारत में एक राष्ट्रीय डोप टेस्टिंग लेबोरेट्री (एनडीटीएल) है। सांसदों ने टेस्टिंग की क्षमता को बढ़ाने के लिए राज्यों में टेस्टिंग लेबोरेट्रीज़ की स्थापना की मांग उठाई। इसके जवाब में मंत्री ने कहा कि अगर भविष्य में जरूरत हुई तो सरकार राज्यों में और टेस्टिंग लेबोरेट्रीज़ बनाएगी। इसके अतिरिक्त टेस्टिंग क्षमता बढ़ाने के लिए निजी लैब भी बनाए जा सकते हैं। खेल संबंधी स्टैंडिंग कमिटी (2022) ने अधिक बड़ी संख्या में डोप टेस्टिंग लेबोरेट्रीज़ खोलने की जरूरत पर भी जोर दिया, विशेष रूप से हर राज्य में एक, ताकि देश की जरूरत पूरी की जा सके और एंटी-डोपिंग विज्ञान और शिक्षा के क्षेत्रों में देश दक्षिण एशिया क्षेत्र का अगुवा बन सके। 

अगस्त 2019 में वाडा ने इंटरनेशनल स्टैंडर्ड्स फॉर लेबोरेटरीज (आईएसएलका पालन नहीं करने के लिए एनडीटीएल पर छह महीने का सस्पेंशन लगाया था। फिर आईएसएल का पालन न करने के कारण जुलाई 2020 में इस सस्पेंशन को और छह महीने के लिए बढ़ा दिया गया था। दूसरा सस्पेंशन तब तक प्रभावी रहता, जब तक कि एनडीटीएल आईएसएल का अनुपालन नहीं करती। हालांकि निलंबन को जनवरी 2021 में और छह महीने के लिए बढ़ा दिया गया क्योंकि कोविड-19 के कारण वाडा लेबोरेट्री का ऑन-साइट एसेसमेंट नहीं कर सकती थी। दिसंबर 2021 में वाडा ने एनडीटीएल की मान्यता बहाल कर दी

जागरूकता बढ़ाना

भारत में बहुत से एथलीट्स एंटी-डोपिंग नियमों और प्रतिबंधित पदार्थों के प्रति जागरूक नहीं हैं। जागरूकता के अभाव में वे सप्लीमेंट्स के जरिए प्रतिबंधित पदार्थों का सेवन कर लेते हैं। सांसदों ने कहा कि एंटी-डोपिंग के संबंध में जागरूकता अभियान चलाए जाने की जरूरत है। मंत्री ने सदन को बताया कि पिछले एक वर्ष में नाडा ने एंटी-डोपिंग संबंधी जागरूकता पैदा करने के लिए 100 हाइब्रिड वर्कशॉप्स चलाईं। बिल नाडा को इस बात के लिए तैयार करेगा कि वह एंटी-डोपिंग पर ज्यादा से ज्यादा जागरूकता अभियान चलाए और अनुसंधान करे। इसके अतिरिक्त केंद्र सरकार भारतीय खाद्य सुरक्षा एवं मानक अथॉरिटी (एफएसएसएआई) के साथ काम कर रही है ताकि एथलीट्स के डायटरी सप्लिमेंट्स को टेस्ट किया जा सके। 

बिल की समीक्षा करते हुए खेल संबंधी स्टैंडिंग कमिटी (2022) ने सुझाव दिया था कि देश में एंटी-डोपिंग इकोसिस्टम में सुधार तथा उसे मजबूत करने के लिए अनेक उपाय किए जाएं। इन उपायों में निम्नलिखित शामिल हैं: (i) ‘डोप फ्री सर्टिफाइड सप्लिमेंट्स की लेबलिंग और इस्तेमाल के लिए रेगुलेटरी कार्रवाई करना, और (iii) एथलीट्स द्वारा इस्तेमाल किए जाने वाले सप्लिमेंट्स के लिए स्वतंत्र निकायों के डोप-फ्री सर्टिफिकेशन को अनिवार्य करना।
